1. Who We Are

This website is operated by Álvaro Carcedo Martínez, trading as Nornelle, contactable at nornelle.shop@gmail.com.

By accessing nornelle.com and using our services, you agree to be bound by these Terms of Service, our Privacy Policy, our Shipping Policy and our Return & Refund Policy. If you do not agree, do not use the website.

Nothing in these Terms excludes, restricts or modifies any right you have as a consumer that cannot be excluded, restricted or modified under the law applicable to you. Where any clause conflicts with a mandatory consumer protection rule, that rule prevails and the rest of these Terms continue to apply.

2. Use of the Website

By using this site you confirm that:

  • You are at least the age of majority in your jurisdiction, or you are using the site with the consent of a parent or legal guardian;
  • The information you provide is accurate, complete and current;
  • You will not use our products or website for illegal or unauthorised purposes.

We may refuse service where there is a legitimate and objective reason to do so, such as suspected fraud, abuse, or a previous breach of these Terms. Where we refuse an order that has already been paid, we refund it in full.

3. Products, Descriptions and Prices

We make every effort to display our products accurately. Product appearance may vary depending on device and screen settings, and we do not guarantee that products will exactly match visual representations in every detail.

This does not affect your right to receive goods that correspond to the description, quantity, quality and functionality announced at the time of purchase.

Prices are shown in USD.

Prices shown to consumers in the EU/EEA are inclusive of VAT. The total price payable, including delivery charges and any additional costs, is displayed before you confirm your order. Where a product is offered at a reduced price, any prior-price reference complies with Article 6a of Directive 98/6/EC (the lowest price applied in the 30 days preceding the reduction).

Prices shown are exclusive of applicable sales tax, which is calculated and displayed at checkout where we are required to collect it. Any advertised comparison price ("was", "compare at", "regular price") refers to a bona fide price at which the item has been offered.

Prices and product descriptions may change, but changes do not affect orders already confirmed.

4. Orders and Acceptance

By placing an order you are making an offer to purchase. The contract is formed when we send you an order confirmation email.

We may:

  • Accept or reject an order for objective reasons (stock, fraud risk, pricing error, delivery restrictions);
  • Limit quantities per customer;
  • Cancel orders where fraud or serious risk is detected.

If we cancel an order after payment, we refund the full amount paid, including the standard delivery charge, without undue delay and in any event within 14 days.

5. Pricing and Payments

You are responsible for providing accurate billing and payment information and confirm that you are authorised to use the payment method provided.

Payments are processed by third-party payment providers. We do not store full card details.

Customs, duties and import taxes. Where goods are shipped from outside your customs territory, import duties or taxes may apply.

Where import VAT is collected at checkout, this is stated clearly before payment and no further charge should be requested on delivery. If we do not collect import charges at checkout, we will say so before you pay, and those charges will be your responsibility. We will not present a total at checkout that conceals unavoidable additional charges.

Any applicable customs duties or import fees for international shipments are the responsibility of the customer and will be disclosed at checkout where known.

6. Shipping, Delivery and Risk of Loss

Delivery times are estimates. Full details are in our Shipping Policy.

Risk of loss remains with us until you, or a third party designated by you other than the carrier, take physical possession of the goods. We will deliver within 30 calendar days of the contract being concluded unless expressly agreed otherwise. If we miss that deadline, you may set an additional reasonable period and, if we still fail to deliver, terminate the contract and receive a full refund.

Title and risk of loss pass to you on delivery to the shipping address you provided. We ship within the timeframe stated at checkout or, where no timeframe is stated, within 30 days, and will offer you the option to cancel with a prompt refund if we cannot, in accordance with the FTC Mail Order Rule (16 CFR Part 435).

We are not responsible for delays caused by carriers, customs authorities or events outside our reasonable control, but this does not affect your right to cancel and be refunded where delivery is significantly delayed.

All returns and refunds are governed by our Return & Refund Policy.

In addition to any commercial return policy we offer voluntarily, you benefit from:

  • the right of withdrawal: 14 calendar days from receipt of the goods, without giving a reason;
  • the legal guarantee of conformity: a minimum of 2 years from delivery under Directive (EU) 2019/771 (3 years for consumers in Spain under Article 120 TRLGDCU), during which you may request repair, replacement, price reduction or termination of the contract if the goods do not conform.

These rights are free of charge and cannot be waived.

Our return policy is set out in full in our Return & Refund Policy and is displayed conspicuously before purchase. Certain states, including California, grant additional rights where a return policy is not conspicuously posted. Implied warranties of merchantability and fitness for a particular purpose apply to the extent they cannot lawfully be disclaimed in your state, and are not excluded by these Terms.

8. Intellectual Property

All content on this website, including images, text, branding and design, is the property of Álvaro Carcedo Martínez or used under licence and is protected by intellectual property law.

You may not reproduce, distribute, modify or commercially exploit any content without prior written consent, save for uses permitted by law.

9. Third-Party Services

Our website may include links to or integrations with third-party services. We are not responsible for their content, policies, or transactions concluded outside our website. This does not affect our own obligations to you in relation to the goods you buy from us.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from use of the website.

Products and services are provided on an "as available" basis with respect to website availability.

We do not exclude or limit liability for: death or personal injury caused by negligence; fraud; defective products under applicable product liability law; the legal guarantee of conformity; or any other liability that cannot lawfully be excluded.

11. Fraud Prevention

We may cancel orders flagged as high-risk or fraudulent and request additional verification. Where we cancel a legitimate order for this reason, we refund it in full.

12. Termination

We may suspend or terminate access to our services where these Terms are seriously or repeatedly violated. Termination does not affect orders already paid for, which will be fulfilled or refunded.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. If you are a consumer resident in another EU/EEA Member State, this choice does not deprive you of the protection of the mandatory rules of your country of residence (Article 6, Regulation (EC) 593/2008). You may bring proceedings in the courts of your place of residence, and we will bring any proceedings against you only there.

These Terms are governed by the laws of Spain, without regard to conflict of law rules. Nothing in this clause deprives you of the protection of the mandatory consumer protection laws of your state of residence, or of your right to bring a claim in small claims court.

15. Changes to These Terms

We may update these Terms. Changes apply from the date they are posted and do not apply retroactively to orders already placed. Continued use of the website after changes are posted constitutes acceptance of the updated Terms for future orders.
